Kasab……….the icon of Indian Judiciary
The Kasab trial is a big slap on Indian judiciary system. If an open and shut case like Kasab continues for over a year then we can just wonder what can be the fate of behind the door murder’s, rape and robberies. Several thousands of cases are still waiting to hear the right judgment. People have spent more on new shoes after several visits to court rooms. They have lost hope. Fast track or slow track courts, the decision does not come on time. Delay in justice is justice denied.
It is just difficult to understand that why we want to prove all the 86 charges framed against him. Examining several witnesses, hiring forensic experts, changing defence lawyers, etc to prove each of the charge is just waste of judicary’s time and money. In my opinion, even if you prove the 4 key charges against him which is very easy to prove, he could be hanged till death. Similarly, even if you prove all the 86 charges after years and years of efforts, he would still be hanged till death. There is no punishment beyond death sentence then why to waste so much time and public money. Prove the key charges and hang him. It is really embarrassing for Indian government that we are not able to punish the terrorist and crime perpetrators in time. This is the very reason people have lost confidence over the Indian judiciary system.
On the other hand, Kasab is least bothered in the case. He knows it really well that in the end he is going to be hanged. We can’t see any remorse on his face. To add further he cracks jokes, acts funny, laughs and behaves outlandishly. Is this not insult of the Indian judiciary?
31 crore rupees spent on him and his security. Is he not a VIP to getting a Z security? On the other hand the families of victims were promised three lakh rupees as compensation. One year after the tragedy, majority of people have still not received their compensation. Out of 403 people eligible only 118 have received the cheques. Thus, the total compensation promised is 12.09 crores whereas the government has already spend 31 crore for one person. This amount will keep on increasing till the time trial continues. On whose cost? It is public money after all.
I would salute the patience of Mr Ujwal Nikam, who is the public prosecutor in this case and has also won many cases in the past as a public prosecutor. It is difficult for a lawyer to continue in an exacerbated environment of changing confessions, witnesses becoming hostile, defence lawyer playing law gimmics, changing judges and judgements. Mr Nikam still is fighting the case with the same rigor and commitment and I am sure he will ensure that Kasab gets the punishment he deserves and he owes that to the people of India.
I hope this case ends before the next 26/11 anniversary. People in India have short memory and slowly they will forget Kasab and the case. I hope I can see Kasab hanging through the noose before I close my eyes forever. It is all hope and I am trying to be positive.

quite gud to know tat there are people who think that there should be reforms in the judiciary.. but the fact is that India has not been able to change its system from the time of the alien rulers.. if one observes carefully, we are still following the system that were laid by them. these people dont have the guts to make a small change either..

I agree. Hang Kasab and also all of those Swadhyayi GOONS, Bharat Bhatt, Daxesh Shah, Ghanshyamsinh Chudasama, Chandrasinh, Mansinh Vagher, etc who brutally killed Mr. Pankaj Trivedi in Ahmedabad as he exposed corruption in SWADHYAY PARIVAR.

completely agree! I do feel we have good laws but too many of them. Our biggest problem is implementation and execution. Only if we can deliver faster judgements like we have in the western world people would really appreciate and trust the Indian judiciary. The time is so bad that even lawyers sometimes suggest to settle out of court as decision might not come on time. Archaic laws need to change and we need to support this.

Small update…the trial on Kasab is over and the judgement will be out in May 2010..Lets hope for a fiery sentence

Nice. You have a couple of great points. When it’s all said and done the police do a good job. The issue with law is that it sometimes doesn’t work effectively. It is a system failure and needs to be fixed.

Agree…but it is not that laws are bad..India has one of the best laws but the issue is enforceability and implementation
